Server Font License Agreement

This Server Font License Agreement (“Agreement”) is a legally binding contract between YahyaType (“Licensor”) and the individual or entity (“Licensee”) intending to use the fonts provided by Licensor for server-based applications. By purchasing and using the fonts, Licensee agrees to abide by the terms and conditions set forth in this Agreement.

1. Definitions

1.1. “Fonts” refer to the typeface designs and any accompanying files or documentation provided by Licensor.

2. Grant of License

2.1. Once the applicable fee is paid and in compliance with the terms of this Agreement, the Licensor provides the Licensee with a non-exclusive, non-transferable, and restricted license to utilize the Fonts as per the stipulations outlined in this Agreement.

3. Permitted Usage

3.1. The Fonts may be used by Licensee for:

a) Generating text for web applications, dynamic content, or server-based documents.

b) Rendering text into rasterized images or graphics for display on websites, in digital presentations, or in printed materials.

c) Incorporating the Fonts into server-based applications, document generation services, and other software or systems that enable font selection.

4. Restrictions

4.1. Licensee is prohibited from:

a) Modifying, adapting, translating, or creating derivative works based on the Fonts, except for basic font manipulation necessary for display or rendering.

b) Sharing, distributing, sublicensing, selling, or leasing the Fonts to any third party, whether for profit or free of charge.

c) Using the Fonts in a manner that infringes upon the intellectual property rights of Licensor or any third party.

d) Employing the Fonts in any unlawful, offensive, or non-compliant manner with applicable laws and regulations.

5. Font Security

5.1. Licensee agrees to take appropriate measures to ensure the security of the Fonts and prevent unauthorized use, distribution, or access.

6. Ownership

6.1. Licensee acknowledges that the Fonts are the exclusive property of Licensor and are protected by copyright and other intellectual property laws.

6.2. Licensee shall not claim ownership or authorship of the Fonts, even if modified or incorporated into other works.

7. Termination

7.1. This Agreement is effective upon the purchase and download of the Fonts and will continue until terminated.

7.2. Licensor may terminate this Agreement immediately if Licensee breaches any of the terms and conditions herein. In such case, Licensee shall cease all use of the Fonts and destroy any copies or backups.

8. Term and Renewal

8.1. This Agreement is valid for one year from the date of purchase and will be automatically renewed each year that the Fonts remain installed on Licensee’s servers.

8.2. Licensor may terminate this Agreement immediately if Licensee breaches any of the terms and conditions herein. In such a case, Licensee must cease all use of the Fonts and destroy any copies or backups.

9. Disclaimer of Warranty

9.1. THE FONTS ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. LICENSOR SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE FONTS.

 

By purchasing and using the Fonts, Licensee acknowledges that they have read, understood, and agreed to be bound by the terms and conditions of this Desktop License Agreement. If you do not agree to these terms, you must not use the Fonts.
